I just wanted to leave a note of correction to your post. The idea that, "But fMRI is all science, and brain scans are already widely admissible at sentencing. They are now de rigeur in capital cases, and the Supreme Court based its ruling precluding execution of adolescents on brain scan evidence." is not correct. First fMRI is an indirect method of assessing brain activity, and the interpretation of that activity involves some "art" in addition to the science, similar to polygraph testing. Second, the Supreme Court based it's ruling excluding execution of adolescents on behavioral evidence, not on fRMI. Although fMRI briefs were filed, they were not mentioned (that is, they were disregarded) in the decision.
