Personal Injury and Medical Malpractice

In general, injuries are compensated with money.  You would rather have the injury taken away, of course, but money damages are usually the best the courts can do.  There are three kinds of damages you may be entitled to:
     "General damages" include compensation for your pain, suffering and disability. 
     "Special damages" reimburse you for your medical bills, lost income, and other out-of-pocket costs. 
     "Punitive damages" are rare.  These are additional money paid as punishment for extraordinarily bad conduct, as opposed to simply compensating you and reimbursing you.

Wrongful death cases add more complexity to the calculation of damages, who is entitled to damages, and what kinds of damages they may be entitled to.


Arbitration and Mediation

Arbitration and mediation are forms of "alternative dispute resolution," by which the two sides of a dispute attempt to resolve their differences formally, but without the time and expense of a drawn-out lawsuit.

Typically, parties have agreed to arbitration or mediation in a contract, such as a credit card agreement or employment agreement.  Other times, the parties may decide to go this route after a dispute has arisen.

Arbitration and mediation results are often binding, and may be enforced by the courts.  Although lawyers are not required for these proceedings, it is often important to have experienced counsel tell your side of the story, negotiate for the outcome you need, and fight to protect your interests.
