White Collar Defense

White-collar crime is a whole new animal these days.  Sentences are higher.  Jurors are less sympathetic.  Law enforcement is using new tools, like wiretaps, once reserved for narcotics and violent offenders.  And corporations come under enormous pressure to cooperate, at the expense of individual officers and employees.

Nathaniel Burney is one of the few lawyers with significant experience in this new arena.  With his mastery of wiretaps as well as complex financial dealings, Mr. Burney excels at protecting clients in even the most challenging cases.

If you are under investigation or indictment, you know that too much is at stake to take any chances.  In the current environment, you stand to lose a lot more than your reputation.

To make things worse, even the best prosecutors often lack a real understanding of the business world.  They may see your case as being much more serious than it really is, and it can be difficult to change their perspective.

Nathaniel Burney is sought after for his skill at getting prosecutors to look at cases in a new way, often convincing the government not to bring charges at all.

Some cases must be fought all the way to trial.  Mr. Burney has the knack of getting judges and juries to understand your side of the story.  You need someone who is not afraid of trial, who also happens to know what he is doing.

A sample of recent clients include an attorney charged with massive embezzlement (Mr. Burney took over the case from another lawyer, and successfully got his client no jail time, over the initial objections of both the government and the judge); a Bear Stearns subprime hedge fund manager (Mr. Burney helped his client persuade the government not to indict him, and also helped persuade others not to call him as a witness, protecting his client's reputation); an executive of an international fuel-supply corporation (who received no jail after Mr. Burney took over at sentencing and convinced the judge that there was no economic loss to the government); and a variety of clients charged with computer crimes, bank fraud, and other offenses.

Mr. Burney is often called in to replace other counsel, but he represents clients at all stages.  Typical services include:

  • Advising clients under investigation, and fighting to avoid or minimize criminal charges.

  • Orchestrating arrests to minimize client and family embarrassment, and providing counsel through all intake procedures.

  • Arguing for reasonable bail, to ensure smooth and speedy restoration of liberty.

  • Fighting criminal charges all the way through trial, including careful and innovative analysis of the evidence, sound strategies, tough negotiation, intelligent and creative legal argument, and skillful courtroom advocacy.

  • Post-trial representation on appeal.
